Terms of Service
These Terms of Service (“Terms”) are a legal agreement between you and J&B Creations LLC (“J&B Creations,” “we,” “us”) governing your use of the HolyShot mobile app and the website at holyshot.cc (together, the “Service”). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. The Service
HolyShot lets you provide a photo of yourself and generates AI portraits of you, depicted as an ordinary, unnamed person in historical and biblical-era settings. Portraits are stylized, AI-generated images — not photographs of real people or records of real events.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent where you live) to use HolyShot. If you are under the age of majority, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms.
3. Your photo and content
You keep ownership of the photo you upload. To provide the Service, you grant us a limited, worldwide, non-exclusive license to process your photo solely to generate your portraits and deliver them to you. Your selfie is not retained after generation, as described in our Privacy Policy.
You represent and warrant that:
- The photo is of you, or of a person who has given you their consent to upload it and create portraits;
- You have all rights necessary to provide the photo; and
- The photo does not infringe anyone's rights or violate any law.
4. Acceptable use
You agree not to:
- Upload photos of other people without their consent, or photos of minors for any improper purpose;
- Use the Service to create misleading, deceptive, defamatory, harassing, or unlawful content, or to impersonate others;
- Attempt to produce content the Service is designed to prevent — including depictions of Jesus, God, the Holy Spirit, or any named or divine figure, or violent, sexual, or hateful content;
- Reverse engineer, scrape, overload, or interfere with the Service, or attempt to access it in unauthorized ways;
- Resell or commercially exploit the Service without our permission.
5. Purchases
HolyShot offers one-time purchases (“packs” and bundles) — there is no subscription. Purchases are made and billed through the App Store or Google Play, and are subject to those platforms' terms. Prices are shown in-app and may vary by region. Refunds and cancellations are governed by Apple's and Google's policies; we generally cannot process refunds directly. Once a pack is purchased, the entitlement is yours and can be restored on your account through the app.
6. AI-generated content
Portraits are generated by an AI model and are fictional, stylized depictions. They may contain inaccuracies or unexpected results, are not historically authoritative, and do not represent real individuals. You may use the portraits you generate for your own personal, non-commercial purposes.
7. Intellectual property
The Service — including the HolyShot name, design, software, and branding — is owned by J&B Creations LLC and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or branding except as needed to use the Service normally.
8. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated results will meet your expectations.
9. Limitation of liability
To the fullest extent permitted by law, J&B Creations LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.
10. Indemnification
You agree to indemnify and hold harmless J&B Creations LLC from any claims, damages, or expenses arising out of your photos or content, your use of the Service, or your violation of these Terms or any law or third-party right.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.
12. Governing law
These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Michigan, unless applicable law requires otherwise.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we'll revise the effective date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
